Sajgani Mango Orchard — Terms & Conditions

1. The nature of tree adoption / produce subscription

  • Symbolic & custodial ownership: adopting a tree under the Sajgani Mango Orchard initiative grants the customer symbolic guardianship and the right to receive produce from the designated orchard plot. It does not convey any legal title, leasehold, tenancy, or real estate ownership of the land or the physical tree itself.
  • Orchard operations: the customer does not have operational control over agricultural practices. Sajgani reserves full discretion over farm management, irrigation, pruning, pest management, and harvesting techniques.

2. Agricultural disclaimers & yield variations (force majeure)

  • Natural product variabilities: farming is subject to nature. While Sajgani applies professional farming practices, harvest volume, fruit size, sweetness, and maturity dates vary from season to season due to climate, sunlight, and rainfall.
  • Crop failure & acts of God: in the unlikely event of unseasonal rains, hail, pest outbreaks, drought, cyclone, frost, or other force majeure events leading to crop damage, Sajgani is not liable for fixed minimum yield guarantees.
  • Mitigation protocol: if a designated tree fails to produce viable fruit in any season due to natural factors, Sajgani reserves the right to fulfill produce commitments using equivalent-grade mangoes from neighboring trees within the orchard or roll forward the entitlement to the next harvest.

3. Harvest schedules & delivery

  • Harvest timelines: harvest windows (typically April–June) are dictated by fruit maturity. Sajgani will communicate estimated shipping windows, but dates are approximate and cannot be treated as time-critical guarantees.
  • Delivery address & updates: customers must confirm or update their delivery address at least 15 days prior to harvest notification. Sajgani is not responsible for non-delivery or spoilage caused by incorrect addresses, locked premises, or customer unavailability.
  • Transit & perishability: mangoes are packed with care and shipped at the optimum ripening stage. Minor skin blemishes or cosmetic variations are natural in farm-fresh produce and do not qualify as damage.

4. Inspection, damage claims & replacement policy

  • Short reporting window: because fresh fruit is highly perishable, any claim regarding severe transit damage, significant spoilage, or package tampering must be reported within 24 hours of delivery.
  • Mandatory proof: claims must be accompanied by unboxing photos/videos showing the package label and the affected fruit.
  • Resolution: verified transit damages will be compensated at Sajgani's discretion through replacement boxes (subject to seasonal fruit availability) or credit adjustments toward subsequent seasons. No cash refunds are issued for natural perishability after delivery.

5. Orchard visits & farm access

  • Prior appointment only: tree adopters are welcome to visit the orchard, but visits must be scheduled at least 7 days in advance to prevent interference with ongoing agricultural work, chemical spraying schedules, or harvest operations.
  • Liability on premises: visitors enter the farm at their own risk. Sajgani is not liable for personal injury, slips, insect stings, or damage to personal belongings during on-farm visits.

6. Payment, subscription period & non-refundability

  • Upfront commitment: adoption/subscription fees are payable in advance and fund long-term care, inputs, and labor for the orchard.
  • Non-refundable: once enrolled for a season or multi-year term, payments are non-refundable, except where Sajgani entirely discontinues the program prior to seasonal deployment.
  • Non-transferable: subscriptions and adoption rights cannot be resold, sub-licensed, or transferred without prior written approval from Sajgani.

7. Intellectual property & promotional use

  • The name "Sajgani", "Sajgani Mango Orchard", brand marks, photographs, videos, and collateral are the exclusive intellectual property of the business.
  • Sajgani reserves the right to capture photos/videos of adoption plaques, harvest events, and visitor days for promotional updates, respecting individual requests for privacy when submitted in writing.

8. Dispute resolution & jurisdiction

  • Any disputes, controversies, or claims arising out of this agreement shall first be attempted to be resolved amicably via mutual discussions.
  • If unresolved, the exclusive jurisdiction for all legal disputes and proceedings shall lie with the competent courts in Latur / Mumbai, Maharashtra, and shall be governed by the laws of India.
